Subject: CONSTITUTION AMENDMENTS

 

Dear Brethren,

The following is a summary of changes to the Book of Constitutions and Administrative Regulations confirmed by Grand Lodge at the Quarterly Communications held from June 2017 to June 2018:

1.

Change to Clauses 13.1, 13.2, 15.8 of the Book of Constitutions, and Regulation R15.8 of the Administrative Regulations:
That the words “Caring Officer” be removed from Clauses 13.1.1, 13.1.3, 13.2.5, 15.8.1 and Regulation R15.8 of the Book of Constitutions and Administrative Regulations and replaced with the words “Masonicare Caring Officer”.

 

STATEMENT OF CAUSE AND EFFECT

The effect of this change with be to officially change the name of the Caring Officer in the list of Lodge Officers appearing in the Book of Constitutions, as it has been effected in the Installation Ceremonial for some time previously. Changes of this title are to appear in all other publications as they are re-printed.

2.

Changes to Clauses 3.22.1 and 3.22.2 of the Book of Constitutions:
That the words “masoniCare Regional Representatives” be removed from Clause 3.22.1 of the Book of Constitutions and replaced with the words “Regional Masonicare Manager”; and that the words “masoniCare District Representatives” be removed from Clause 3.22.2 of the Book of Constitutions and replaced with the words “District Masonicare Representative”.

 

STATEMENT OF CAUSE AND EFFECT

The effect of this change with be to officially change the name of the Regional and District Masonicare Officers in the list of Lodge Officers appearing in the Book of Constitutions, as it has been effected in the Operational Manual of the Grand Charity for some time. Changes of these titles are to appear in all other publications as they are re-printed.

Addition of the following new Clause 6.1.5 (e) to the Book of Constitutions:
“The ballot shall be conducted simultaneously in Lodge Rooms located in the Sydney Masonic Centre, and additional NSW & ACT regions, based on membership and proximity to Sydney, such as: Northern Rivers, New England, Mid North Coast, Newcastle, Central Coast, Blue Mountains, Central West, Riverina, Wollongong, South Coast, far South Coast and the Australian Capital Territory and such other venues outside the Sydney metropolitan area, as the Grand Master (or if the Grand Master seeks re-election in a contested ballot, the Executive Council) may appoint, provided that if for any reason it is reasonably impracticable to hold a meeting at any one or more of those venues, listed or appointed, the failure to do so will not invalidate the ballot. In the case of Lodge Rooms or venues other than the Grand Lodge Room in Sydney the meeting shall be presided over by a Brother appointed by the Grand Master (or if the Grand Master seeks re-election in a contested ballot, by the Executive Council) and notified by the Grand Secretary. The meetings held at the several venues shall be deemed to form part of the Communication at which the ballot is held and any votes cast at those venues shall be included in the overall votes cast. This Clause to take effect prior to the Election to be held at the March 2019 Grand Communication.”

 

STATEMENT OF CAUSE AND EFFECT

It is most important to note that this proposed amendment does not take effect until the election (if required) which will be held in March 2019.

The amendment permits brethren outside Sydney to vote in the election of Grand Master by attending venues in the Sydney Masonic Centre, and additional NSW & ACT regions, based on membership and proximity to Sydney, such as: Northern Rivers, New England, Mid North Coast, Newcastle, Central Coast, Blue Mountains, Central West, Riverina, Wollongong, South Coast, far South Coast and the Australian Capital Territory and such other venues outside the Sydney Metropolitan area as may be appointed.

Such Centres which could be included, as examples, might be: Tweed Heads, Tamworth, Coffs Harbour, Taree, Newcastle, Gosford, Lawson, Bathurst, Parkes, Wagga Wagga, Gwynneville, Nowra, Pambula and Canberra.

Changes to Clause 17.7.6 of the Book of Constitutions and Regulations R17.3.5 (c), R17.3.5 (e) and deletion of Regulations R17.3.5 (f) & (g) of the Administrative Regulations:

Book of Constitutions – Delete Clause 17.7.6 and insert:
“A Brother appointed to act as a nominator in terms of Clause 17.3.5 and its associated Regulations shall be ineligible to be a member of the committee at that meeting.”

Administrative Regulations – Delete Regulation R17.3.5 (c) and insert:
“If the District Grand Inspector of Workings, and such other Grand Lodge Officer not below the Rank of PDGIW, as may be nominated, informs the Lodge Secretary that he and such other Brother consent to have their respective names shown as nominators of the applicant, they shall have all the rights and obligations of a nominator under Clause 17.3.2 of the Book of Constitutions. The procedure set out in Regulations R14.4.2 to R17.9.7 and their associated Clauses in the Book of Constitutions inclusive shall be followed in so far as is applicable in the circumstances of the particular case. The nominators shall, whenever
mentioned as such, be referred to by their respective names and Ranks followed by the words “on behalf of the Board of Management”.

Administrative Regulations – Delete Regulation R17.3.5 (e) and insert:
“The Grand Secretary shall examine the documentation and subject to any other provisions contained in these Regulations may permit the applicant’s nomination to proceed.”

Administrative Regulations – Delete existing Regulations R17.3.5 (f) and (g).

 

STATEMENT OF CAUSE AND EFFECT

This ensures that all required information is received for prospective candidates and that changes can be implemented quickly and efficiently.

It also deletes the need for a specific dispensation for each and every applicant. It gives the DGIW and other Grand Lodge Officers of PDGIW Rank, or above, the authority to act as Nominators on behalf of the Board of Management without the need for Dispensation.

These changes have been/will be made to subsequent re-prints of the Book of Constitutions and Administrative Regulations.
